They were both arrested on March 24 in connection with Jose's death at La Nucia, near their home in the village of Polop. ..The trial which started today at Central Alicante Courts heard how 17-year-old Jose died in hospital as a result of the injuries sustained by being dragged so far under Cook's Hyundai Matix. Cook attempted to miss the young rider but was unable to do so and ran over him, finally freeing the victim's body by driving backwards and forwards until it dropped clear. Cook was pursued by a witness who followed a trail of blood in the road until reaching the seriously injured victim, who died later in hospital. The most serious charge reportedly facing them is an allegation of imprudent homicide, although Mr Cook has told his family he believed they had hit a speed hump or a dog. ..The state prosecutor is demanding a 13-year prison sentence for Cook for manslaughter and reckless driving as pathologists are due to give evidence that the moped rider received a serious head injury in the collision with the first car, but that it would not have been fatal.
